利用規約

ClipMarkCamera（以下「本アプリ」）をご利用いただきありがとうございます。本利用規約（以下「本規約」）は、本アプリの利用条件および開発者（以下「当方」）とユーザーの皆さまとの間の権利義務関係を定めるものです。

1. 適用

  1. 本規約は、ユーザーが本アプリを利用する一切の場合に適用されます。
  2. 本アプリ内の説明、ヘルプ、注意書き等がある場合、それらも本規約の一部を構成します（内容が矛盾する場合は本規約が優先します）。

2. 本アプリの概要（提供する機能）

  • 動画/写真の撮影、ズーム、露出補正、グリッド、タイマー
  • 録画中の区間マーク、クイックハイライト、プリロール
  • フル動画/クリップ/写真の保存・書き出し
  • アーカイブ管理（お気に入り・フォルダ）
  • プライバシーモード（端末認証またはアプリPIN）
  • iCloudバックアップ/復元（プレミアム）
  • 広告表示、プレミアム課金

3. 権限と同意

本アプリはカメラ・マイク・写真ライブラリ・位置情報等へのアクセス権限を必要とする場合があります。ユーザーは各権限の許可/不許可を設定でき、当該機能の利用はユーザーの同意を前提とします。

4. 禁止事項

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

  • 法令、公序良俗に反する行為、またはこれを助長する行為
  • 他者の権利（著作権、プライバシー、肖像権等）を侵害する行為
  • 盗撮、無断録音など、撮影・録音に関する法令や施設ルールに違反する行為
  • 本アプリ・当方・第三者（広告事業者や決済事業者を含む）に不当な負荷をかける行為
  • 本アプリの改変、リバースエンジニアリング、解析、脆弱性探索等（法令で認められる場合を除く）
  • 本アプリの不具合を意図的に悪用する行為
  • その他、当方が不適切と判断する行為

5. データの保存・取り扱い（重要）

  1. 本アプリで作成される動画・クリップ・写真・マーク情報等は、原則として端末内に保存されます。
  2. iCloudバックアップ機能を有効にした場合、データはユーザーのiCloud Driveに保存されます。
  3. 写真アプリに保存したデータの管理はユーザー自身で行ってください。

6. 免責事項

  1. 本アプリは「現状有姿」で提供されます。当方は、本アプリの中断・停止・不具合・データ消失等について、直接/間接を問わず責任を負いません。
  2. 端末やOSの状態により、すべての機能が動作することを保証しません。

7. 課金・サブスクリプション

  1. サブスクリプションの購入・更新・解約はAppleの決済システムに従います。
  2. 料金はApp Storeの表示価格に従います。
  3. 購入の復元はアプリ内の「購入を復元」から行えます。

8. 返金

  1. App Store経由の購入（サブスクリプションを含む）の請求・返金は、原則としてAppleが取り扱います。
  2. 返金の可否、返金額、処理時期等は、Appleの判断およびAppleの利用規約・ポリシーに従います。当方はApp Store決済に関する返金を保証できません。
  3. 返金を希望する場合は、Appleの返金手続き（例：reportaproblem.apple.com など）から申請してください。

9. 広告（リワード広告等）

  1. 本アプリは、広告（例：リワード広告）を表示する場合があります。広告の表示・計測・不正防止等のため、第三者SDKを利用することがあります。
  2. 広告により取得・利用される情報、オプトアウト等の詳細は、各事業者のプライバシーポリシーをご確認ください。
  3. 広告の内容やリンク先は当方が保証するものではありません。

10. 外部通信（アップデート確認等）

本アプリは、最新バージョンの確認のためにAppleのエンドポイントへ通信する場合があります。

11. 損害賠償の制限

当方の責任は、（有料機能がある場合）直近1か月にユーザーが当方に支払った利用料金を上限とします。

12. 利用停止・提供終了

当方は、ユーザーが本規約に違反した場合、または本アプリの運営上必要と判断した場合、事前通知なく本アプリの提供を停止または終了できるものとします。

13. 本規約の変更

当方は、法令改正、機能変更等に応じて本規約を変更することがあります。重要な変更がある場合、適切な方法で告知します。変更後にユーザーが本アプリを利用した場合、変更後の規約に同意したものとみなします。

14. 準拠法・裁判管轄

本規約は日本法を準拠法とし、本アプリに関して当方とユーザーの間で生じた紛争については、当方所在地を管轄する裁判所（または東京地方裁判所）を第一審の専属的合意管轄裁判所とします。

Thank you for using ClipMarkCamera (the "App"). These Terms of Service ("Terms") govern your use of the App and define the relationship between you and the developer ("we").

1. Scope

  1. These Terms apply to all use of the App.
  2. In-app notices and help text form part of these Terms. If there is any conflict, these Terms prevail.

2. App Features

  • Video/photo capture, zoom, exposure adjustment, grid, timer
  • Highlight markers, quick highlights, pre-roll
  • Save/export full videos, clips, and photos
  • Archive management (favorites, folders)
  • Privacy mode (device authentication or app PIN)
  • iCloud backup/restore (Premium)
  • Ads and premium subscription

3. Permissions and Consent

The App may request access to the camera, microphone, photos library, location, and other device features. You can grant or deny permissions in iOS settings. Some features require consent.

4. Prohibited Conduct

You must not:

  • Violate laws or public order
  • Infringe the rights of others (copyright, privacy, portrait rights, etc.)
  • Record or film in violation of laws or venue rules
  • Impose excessive load on the App, us, or third parties
  • Modify, reverse engineer, analyze, or exploit vulnerabilities (except as permitted by law)
  • Abuse bugs or vulnerabilities
  • Engage in any other conduct we deem inappropriate

5. Data Storage and Handling

  1. Videos, clips, photos, and marker data are stored on your device.
  2. If you enable iCloud backup, data may be stored in your iCloud Drive.
  3. You are responsible for managing items saved to the Photos app.

6. Disclaimer

  1. The App is provided "as is." We are not liable for interruptions, failures, or data loss.
  2. We do not guarantee compatibility with all devices or OS versions.

7. Purchases and Subscriptions

  1. Purchases and subscriptions are handled by Apple’s payment system.
  2. Prices follow the App Store display prices.
  3. You can restore purchases from the in-app "Restore Purchases" action.

8. Refunds (Handled by Apple)

  1. Payments and refunds for purchases made through the App Store are generally handled by Apple.
  2. Refund eligibility and processing are determined by Apple in accordance with its policies.
  3. To request a refund, use Apple’s refund request process (e.g., reportaproblem.apple.com).

9. Ads

The App may display ads (including rewarded ads) and may use third-party SDKs. Please review each provider’s policies for details.

10. Network Communications

The App may contact Apple endpoints to check for newer versions.

11. Limitation of Liability

Our liability, if any, is limited to the amount you paid to us in the last one month for paid features.

12. Suspension/Termination

We may suspend or terminate the App without prior notice if you violate these Terms or if necessary for operation.

13. Changes

We may modify these Terms to reflect legal or functional changes. Material changes will be announced appropriately. Continued use after changes constitutes acceptance.

14. Governing Law and Jurisdiction

These Terms are governed by Japanese law. Any disputes shall be subject to the exclusive jurisdiction of the court having jurisdiction over our location (or the Tokyo District Court).
