本利用規約（以下「本規約」）は、FilmLayerPro（以下「本アプリ」）の利用条件を定めるものです。ユーザーは、本アプリを利用することにより、本規約に同意したものとみなされます。

1. 適用

本規約は、本アプリの利用に関して、ユーザーと開発者との間の一切の関係に適用されます。

2. 本アプリの内容

本アプリは、Windows上でWebページ、画像、動画、テキスト、フォルダ等を表示し、複数のコンテンツを重ね合わせながら作業できるオーバーレイワークスペースを提供します。

主な機能には以下が含まれます。

Web表示
ローカルファイル表示
フォルダ閲覧
セッション保存・復元
ブックマーク管理
ウィンドウ透過・クリック透過
グローバルホットキー
外部ブラウザエンジンを用いたWebレンダリング

3. 利用環境

本アプリは、対応するWindows環境上での利用を前提としています。利用に必要な端末、OS、周辺ソフトウェア、ネットワーク環境は、ユーザー自身の責任と費用で準備するものとします。

4. 外部サービスおよび外部コンポーネント

本アプリは、機能提供のために WebView2、CefSharp その他の外部コンポーネントを利用する場合があります。また、Webページ表示やブックマークプレビュー取得に伴い、外部サイトへアクセスすることがあります。

これらの外部サービスや外部サイトの利用には、それぞれの利用条件やプライバシーポリシーが適用されます。

5. 禁止事項

ユーザーは、本アプリの利用にあたり、以下の行為をしてはなりません。

法令または公序良俗に違反する行為
他者の権利や利益を侵害する行為
本アプリまたは関連コンポーネントに対する不正アクセス
本アプリのリバースエンジニアリング、逆コンパイル、解析等（法令で認められる場合を除く）
本アプリを利用して有害なコンテンツや違法情報を表示・拡散する行為
本アプリの不具合や仕様を悪用する行為
開発者または第三者へ不当な損害を与える行為
その他、開発者が不適切と判断する行為

6. ユーザーデータ

本アプリは、設定情報、ブックマーク、セッション情報等をユーザー端末内に保存します。ユーザーは、必要に応じて自らバックアップ、削除、管理を行うものとします。

開発者は、ユーザーデータの消失、破損、互換性問題等について責任を負いません。

7. Web機能に関する注意

本アプリで表示されるWebコンテンツは、各Webサイトの提供内容に依存します。開発者は、表示される情報の正確性、安全性、継続性、合法性を保証しません。

ブックマークプレビュー、favicon取得、Web表示等が、アクセス先サイトの仕様変更により正常に動作しなくなる場合があります。

8. 免責事項

開発者は、本アプリを現状有姿で提供します。開発者は、本アプリについて、特定目的適合性、完全性、正確性、継続性、有用性、非侵害性等を保証しません。

開発者は、ユーザーが本アプリを利用したこと、または利用できなかったことにより生じた一切の損害について、開発者に故意または重過失がある場合を除き、責任を負いません。

9. 提供内容の変更・停止

開発者は、ユーザーへの事前通知なく、本アプリの全部または一部について、内容の追加、変更、中断、終了を行うことができます。

10. 知的財産権

本アプリおよび本アプリに含まれるプログラム、UI、画像、文章、構成その他一切の知的財産権は、開発者または正当な権利者に帰属します。

11. 規約の変更

開発者は、必要と判断した場合、本規約を変更できるものとします。重要な変更がある場合は、配布ページまたは公式サイト等で周知することがあります。

12. 準拠法・裁判管轄

本規約は日本法に準拠します。本アプリに関して紛争が生じた場合、開発者の所在地を管轄する裁判所または東京地方裁判所を第一審の専属的合意管轄裁判所とします。

These Terms of Service (“Terms”) govern the conditions of use of FilmLayerPro (the “App”). By using the App, the user is deemed to have agreed to these Terms.

1. Scope

These Terms apply to all relationships between the user and the developer regarding the use of the App.

2. App Description

The App provides an overlay workspace on Windows that allows users to display web pages, images, videos, text files, folders, and other content while stacking multiple contents together.

Main features include:

Web viewing
Local file viewing
Folder browsing
Session save and restore
Bookmark management
Window transparency and click-through mode
Global hotkeys
Web rendering using external browser engines

3. Environment

The App is intended for use on supported Windows environments. The user is responsible for preparing and maintaining the device, OS, related software, and network environment required to use the App.

4. External Services and Components

The App may use external components such as WebView2 and CefSharp to provide its features. It may also access external websites for web rendering and bookmark preview generation.

The use of such external services and websites is subject to their respective terms and privacy policies.

5. Prohibited Conduct

Users must not engage in the following acts when using the App:

Violating laws or public order and morals
Infringing the rights or interests of others
Unauthorized access to the App or related components
Reverse engineering, decompiling, or analyzing the App except where permitted by law
Using the App to display or distribute harmful or illegal content
Exploiting bugs or specifications of the App
Causing unreasonable damage to the developer or third parties
Any other act the developer considers inappropriate

6. User Data

The App stores settings, bookmarks, session information, and similar data on the user’s device. Users are responsible for backing up, deleting, and managing such data as needed.

The developer shall not be responsible for loss, corruption, or compatibility issues related to user data.

7. Notes on Web Features

Web content displayed by the App depends on the content provided by each website. The developer does not guarantee the accuracy, safety, continuity, or legality of such content.

Bookmark previews, favicon retrieval, and web rendering may stop working properly due to specification changes on accessed sites.

8. Disclaimer

The App is provided on an “as is” basis. The developer makes no warranties regarding fitness for a particular purpose, completeness, accuracy, continuity, usefulness, or non-infringement.

The developer shall not be liable for any damages arising from the use of or inability to use the App, except in cases of intentional misconduct or gross negligence by the developer.

9. Changes or Suspension

The developer may add, modify, suspend, or terminate all or part of the App without prior notice to users.

10. Intellectual Property

All intellectual property rights related to the App, including its programs, UI, images, text, and structure, belong to the developer or legitimate rights holders.

11. Changes to the Terms

The developer may revise these Terms when deemed necessary. Important changes may be announced on the distribution page or official website.

12. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Japan. Any disputes relating to the App shall be subject to the exclusive jurisdiction of the court having jurisdiction over the developer’s location or the Tokyo District Court as the court of first instance.
